(2) A Justice should disqualify himself or herself in a proceeding in which the Justice’s impartiality might reasonably be questioned, that is, where an unbiased and reasonable person who is aware of all relevant circumstances would doubt that the Justice could fairly discharge his or her duties. Such instances include, but are not limited to, those in which:
(a) The Justice has a personal bias or prejudice concerning a party, or personal knowledge of disputed evidentiary facts concerning the proceeding;

Given the known symbolism of the two flags flown by insurrectionists at the Capitol 1/6/21, the timing of Alito's flying them, the duration of Alito's flying them, and Alito's acknowledgement of and woefully inadequate "my dog ate my homework" explanation for the flag flying so soon after the 1/6/21 insurrection, I do not know how one can reasonably avoid the conclusion that Alito's participation in and ruling on Trump, Trump election, and insurrection/Capitol riot cases wreaks of the "appearance of impropriety" such that the 5/24/24 letter of Senators Durbin and Whitehouse to the Chief Justice was not only warranted, it was-at a bare minimum-required. One could reasonably conclude that the Supreme Court, with Alito (and Thomas) participating, has already effectively put a thumb, hand, and arm on the scales of Justice by granting and continuing to grant Trump the delay he so desperately sought of trial of the 1/6/21 insurrection case while denying and continuing to deny the entire nation its right to a speedy trial of that case. One could also reasonably conclude that the message that delay has sent to the entire nation has been received by Trump-appointed Judge Aileen Cannon, who has delayed indefinitely Trump's stolen government documents and obstructions of justice case in Florida. As if we needed a reminder, Justice delayed is Justice denied. Need one even ask what the Republican House and Senate members would demand were one of Justices Kagan, Sotomayor, or Brown to have flown a Biden-Harris flag while Trump was pursuing his 60+ lawful election challenges? Recusal, I suspect, would be a very long way from enough to satisfy their appetite.
